Terms of Service

Agreement to Terms

By downloading, installing, or using the HumnRX mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

HumnRX is a strength training and workout tracking application that allows users to:

• Log workouts, exercises, sets, reps, and weights
• Track workout history and personal records
• Create and use workout templates
• View progress statistics and trends
• Set workout reminders

Eligibility

You must be at least 13 years old to use HumnRX. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

User Accounts and Subscriptions

Free Tier

HumnRX offers a free tier with limited features after an initial 30-day trial period. Free tier limitations include:

• Access to the 7 most recent workouts in History
• Limited access to progress charts and analytics
• View-only access to templates

Premium Subscription

Premium features are available through a paid subscription. Subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions.

• Billing: Subscriptions are billed in advance on a monthly or annual basis
• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Cancellation: You can manage and cancel your subscription through your Apple ID account settings
• Refunds: Refund requests must be directed to Apple in accordance with their refund policies

Price Changes

We reserve the right to change subscription prices. Any price changes will apply to subsequent billing cycles and you will be notified in advance.

Acceptable Use

You agree to use HumnRX only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Use the App to transmit harmful code or interfere with its operation

Intellectual Property

Our Rights

HumnRX and its original content, features, and functionality are owned by HumnRX and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any workout data, templates, and other content you create using the App. By using the App, you grant us a limited license to process this data solely for the purpose of providing the App's services to you.

Disclaimers

"As Is" Basis

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of data

Service Availability

We do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions.

Limitation of Liability

To the maximum extent permitted by applicable law, HumnRX, its owners, directors, employees, partners, agents, suppliers, or affiliates shall not be liable for:

1. Any indirect, incidental, special, consequential, or punitive damages
2. Any loss of profits, data, use, goodwill, or other intangible losses
3. Any personal injury or property damage arising from your use of the App
4. Any injury sustained during exercise or physical activity
5. Any errors or omissions in the App's content or functionality
6. Any unauthorized access to or use of our servers or any personal information stored therein
7. Any interruption or cessation of service
8. Any bugs, viruses, or other harmful code that may be transmitted through the App

In no event shall our total liability to you for all claims exceed the amount you paid us in the twelve (12) months prior to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless HumnRX and its owners, directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your exercise activities
• Any injury to yourself or others arising from physical activity
• Your violation of any rights of a third party

Modifications to Service

We reserve the right to:

• Modify or discontinue the App (or any part thereof) at any time
• Change features, functionality, or content
• Impose limits on certain features or restrict access to parts of the App

We will make reasonable efforts to notify users of significant changes but are not obligated to do so.

Modifications to Terms

We may revise these Terms at any time by posting the updated version in the App. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically for any changes.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• You may export your data before termination using the Export feature
• We have no obligation to maintain or provide your data

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through:

1. Informal Negotiation: We encourage you to contact us first to resolve any disputes informally
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HumnRX regarding the use of the App and supersede all prior agreements and understandings.
